This website is operated by MyChurchdown. Throughout the site, the terms “we”, “us” and “our” refer to MyChurchdown. MyChurchdown offers this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here.

By accessing or using the Site in any manner, including, but not limited to, visiting or browsing the Site or contributing content or other materials to the Site, you agree to be bound by these Terms and Conditions. Capitalized terms are defined in this Agreement.

We reserve the right to update, change or replace any part of these Terms of Service by posting updates and/or changes to our website. Certain products or services may be available exclusively online through the website. These products or services may have limited quantities and are subject to return or exchange only.

We have made every effort to display as accurately as possible the colours and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any colour will be accurate.

We reserve the right but are not obligated, to limit the sales of our products or Services to any person, geographic region or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of us. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited.

SECTION 4 – ACCURACY OF BILLING AND ACCOUNT INFORMATION

We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the e-mail and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders that, in our sole judgment, appear to be placed by dealers, resellers or distributors.

You agree to provide current, complete and accurate purchase and account information for all purchases made at our store. You agree to promptly update your account and other information, including your email address and credit card numbers and expiration dates so that we can complete your transactions and contact you as needed.

SECTION 5 – OPTIONAL TOOLS

We may provide you with access to third-party tools over which we neither monitor nor have any control nor input.

You acknowledge and agree that we provide access to such tools “as is” and “as available” without any warranties, representations or conditions of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools.

Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s).

If, at our request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us.

We may monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms of Service.

You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false e-mail address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Occasionally there may be information on our site or in the Service that contains typographical errors, inaccuracies or omissions that may relate to product descriptions, pricing, promotions, offers, product shipping charges, transit times and availability. We reserve the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).

We undertake no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website should be taken to indicate that all information in the Service or on any related website has been modified or updated.

SECTION 10 – THIRD PARTY COPYRIGHT

Some of the content used on our website(s) (such as, but not limited to, images and/or audio-visual material) are copyrighted works which belong to and are supplied by third parties (including but not limited to Getty Images, Gloucestershire Live, BBC, Sky News, ITV and ITN), who reserve all their rights in such content.

SECTION 11 – COMPETITION T&C’S

Employees of MyChurchdown or their family members or anyone else connected in any way with helping to set up competitions shall not be permitted to enter.

There is no entry fee and no purchase necessary to enter competitions unless stated in the individual competition T&C’s. Closing date for entry will be displayed on the Competition post. Entries received after this date will not be counted.

MyChurchdown reserves the right to cancel or amend competitions and these terms and conditions without notice. Any changes to the competition will be notified to entrants as soon as possible. No cash alternative to the prizes will be offered. The prizes are not transferable. We reserve the right to substitute any prize with another of equivalent value without giving notice. Winners will be chosen at random by competition entrant software.

The winner(s) will be notified by email within 7 days of the closing date. If the winner cannot be contacted or does not claim the prize within 14 days of notification, we reserve the right to withdraw the prize from the winner and pick a replacement winner.

By entering all competitions, the entrant is indicating his/her agreement to be bound by these terms and conditions.

The winner agrees to the use of his/her name and image in any publicity material. Any personal data relating to the winner or any other entrants will be used solely in accordance with current UK data protection legislation and will not be disclosed to a third party without the entrant’s prior consent.

Entry into the competition will be deemed as acceptance of these terms and conditions. MyChurchdown’s competitions are in no way sponsored, endorsed or administered by, or associated with, Facebook, Twitter or any other Social Network. You are providing your information to MyChurchdown and not to any other party. The information provided will be used in conjunction with the Privacy Policy.

SECTION 12 – ONLINE STORE TERMS – INCLUDING E-TICKETS

You may not use our products for any illegal or unauthorized purpose nor may you, in the use of the Service, violate any laws in your jurisdiction (including but not limited to copyright laws). E-Ticketing software is developed by Jack Vockins / Webterior. Ticket Validation is in use. In the event of cancellation due to circumstances beyond our control, we will endeavor to reschedule the event. If unable to do so, we will issue a full refund.

A breach or violation of any of the Terms will result in an immediate termination of your Services.

The Site and its content are delivered on an “as-is” and “as-available” basis. We may update the content and make improvements or changes in the information, services, and other materials on this Site at any time without notice.

Conditions of sale

No tickets may be used for competitions or promotions without written permission from MyChurchdown.

As a result of entry into an event all customers consent to the following:

  • No admission without a wristband or ticket.
  • Photo ID regarding the age of children or adults attending may be requested at the entry point.
  • Vehicles are left at your own risk.
  • Admission for latecomers is not guaranteed although offered wherever possible.
  • Event line-up and layout is subject to change.
  • Main market venues are fully accessible to wheelchair users and mobility scooters.
  • Please be aware that there are some uneven surfaces and that the Firework Extravaganza can be crowded.
  • No animals will be admitted to the site other than assistance dogs.
  • Trespassing on ‘no public access’ areas or adjoining private property is prohibited.
  • Ticket holders consent to the photography, filming, sound recording as members of the audience, which may be used for promotional or commercial activities.
  • Ticket holders enter at their own risk.
  • Dangerous or drunk and disorderly behaviour will result in immediate removal from the site
  • Rights of admission reserved, no refunds will be given to any ticket-holders who may be refused entry due to behaviour/intoxication or believed to be under the influence of illegal drugs
  • Strictly no trading is allowed on event sites or public areas without written permission.
  • The organisers reserve the right to implement any restrictions/conditions deemed necessary before and during the event to ensure the safe management of the site.

In order to prevent fraud and to protect both parties, you may be asked to provide additional information after your booking so that we can verify your purchase.

We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website.
